Valid from: 01.10.2026
1.1 These Terms and Conditions ("Terms") govern the purchase contract between GRAPHITE STUDIO s.r.o., registered office [address], company ID 24210595, VAT ID CZ2421059, email - info@ty-o.com, phone [phone] ("Seller"), and the buyer ("Buyer") concluded through the online shop ty-o.com ("E-shop").
1.2 The Terms are governed by Czech law, in particular Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. (Consumer Protection Act).
1.3 A consumer is a person who buys goods outside their business or professional activity. An entrepreneur is a person who buys in connection with their business. Provisions that apply only to consumers are marked as such.
1.4 Personal data is processed in accordance with our [Privacy Policy].
2.1 Product information and prices on the E-shop are informative. The Seller may correct obvious errors (e.g., a clearly wrong price) and offer the Buyer the option to confirm the order at the correct price or cancel it.
2.2 The Buyer places an order by filling in the order form and clicking "Order with obligation to pay". Before sending, the Buyer can check and correct the entered data.
2.3 The purchase contract is concluded when the Seller confirms the order by email. The Buyer will receive the Terms and order details by email.
2.4 The Seller may cancel an order if the goods are unavailable, the price was incorrect, or the order appears fraudulent. Any payment already made will be refunded.
3.1 All prices include VAT unless stated otherwise. Delivery and payment fees are shown in the cart before the order is submitted.
3.2 Accepted payment methods: [bank transfer / online card payment / cash on delivery / other].
3.3 For prepayment, the Buyer must pay within [X] days of the order confirmation; otherwise the Seller may cancel the order.
3.4 The Seller issues an invoice (tax document) sent by email [and/or enclosed with the goods].
4.1 Goods are delivered to the address or pick-up point chosen by the Buyer through [carrier names]. Delivery times are stated in the E-shop and in the order confirmation.
4.2 The Buyer must check the package on delivery. If it is visibly damaged, the Buyer should not accept it (or should have a damage report drawn up with the courier) and notify the Seller immediately.
4.3 The risk of damage to the goods passes to the Buyer on takeover. For consumers, the risk passes only once the goods are actually received.
4.4 If delivery fails repeatedly for reasons on the Buyer's side, the Seller may withdraw from the contract and charge the actual costs incurred.
5.1 A consumer has the right to withdraw from the contract without giving a reason within 14 days of receiving the goods. For an order with several items delivered separately, the period starts when the last item is received.
5.2 To withdraw, send a clear statement to [email / address]. You may use the withdrawal form available at [link]; using it is optional. It is enough to send the notice before the deadline expires.
5.3 The Buyer must send or hand over the goods to the Seller within 14 days of the withdrawal notice. The goods should be returned complete, undamaged, preferably in the original packaging, and without signs of use beyond what is needed to examine them.
5.4 The Buyer bears the direct costs of returning the goods [unless stated otherwise by the Seller]. Cash-on-delivery parcels will not be accepted.
5.5 The Seller will refund all payments received, including standard delivery costs, within 14 days of the withdrawal notice, using the same payment method unless agreed otherwise. The Seller may withhold the refund until the goods are received or the Buyer proves they were sent. Additional costs for a more expensive delivery method chosen by the Buyer are not refunded.
5.6 The Buyer is liable for any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature and functioning. The Seller may offset a justified claim for this against the refund.
5.7 The right of withdrawal does not apply in particular to:
5.8 Entrepreneurs have no statutory right to withdraw. Returns are possible only by agreement with the Seller.
6.1 Seller's responsibility. The Seller is responsible for ensuring that the goods are free of defects on receipt. In particular, the goods must match the agreed description and quality, be fit for the purpose for which they are normally used, and come with the expected accessories, instructions and packaging.
6.2 Warranty period. For consumers the warranty period is 24 months from receipt of the goods. For used goods, the period may be shortened by agreement to no less than 12 months, if the consumer was informed in advance. For entrepreneurs, the period is [12/24] months. Any longer manufacturer's warranty is stated in the warranty card.
6.3 Presumption of defect. If a defect appears within one year of receipt, it is presumed to have existed at receipt, unless this is contrary to the nature of the goods or the Buyer caused it. After this period, the Buyer may need to prove that the defect existed at receipt.
6.4 What the warranty does not cover: wear and tear from normal use, damage caused by improper use or storage, mechanical damage, unauthorised repairs or modifications, and damage caused by external events.
6.5 How to make a complaint.
6.6 Buyer's rights. If the goods are defective, the consumer may choose between:
The Seller may refuse the chosen remedy if it is impossible or disproportionately expensive and offer another remedy instead. A consumer cannot withdraw from the contract for an insignificant defect.
6.7 Handling time. The Seller will decide on the complaint without undue delay, within 3 working days of receipt, or, in complex cases, after an expert assessment. The complaint, including removal of the defect, will be resolved within 30 days of being made, unless a longer period is agreed with the consumer. After this period, the consumer may withdraw from the contract.
6.8 Costs. The Seller bears the necessary costs of a justified complaint, including postage. If the complaint is found unjustified, the Seller may charge reasonable costs of the assessment.
6.9 Resolution. The Seller will inform the Buyer in writing of the outcome. The warranty period is extended by the time the Buyer was unable to use the goods due to the complaint. In case of replacement, a new warranty period starts for the replaced goods.
7.1 Complaints and requests may be sent to [info@ty-o.com. The Seller will respond within 30 days.
7.2 If the dispute is not resolved, a consumer may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, www.coi.cz, for out-of-court resolution of the dispute.
7.3 The Seller is authorised to sell goods under a trade licence. Trade licensing supervision is carried out by the relevant trade licensing office. The Czech Trade Inspection Authority supervises compliance with consumer protection law.
All content of the E-shop (texts, images, logos, design, software) is protected by copyright and may not be used without the Seller's consent.
9.1 The contract is concluded in English [and Czech] and archived by the Seller for the time needed for its performance; it is not accessible to third parties.
9.2 Relations not regulated by these Terms are governed by Czech law. Consumer rights under mandatory law of the Buyer's country of residence remain unaffected.
9.3 If any provision is invalid, the remaining provisions remain in effect.
9.4 The Seller may change the Terms. The Terms in force at the time of the order apply to that order.
9.5 Attached: Annex 1 – Withdrawal form, Annex 2 – Complaint form (optional).
